Here the Claimant sought care as a head of loss. The Defendant offered zero for this and entered a full defence. The Claimant removed the claim from the Portal and issued Part 7 proceedings in response, claiming that given the dispute and the nature of the defence, the Portal was no longer suitable.

 

However, the court found that the claim should have stayed in the Portal and restricted the Claimant to Portal costs.
